Doesn’t the at-fault driver’s insurance pay my bills as they come?

No — and this surprises almost everyone. The other driver’s insurer pays once, at the end, when you settle or win. Until then, your treatment runs through your own resources: health insurance, Med-Pay, or lien arrangements.

Should I use my health insurance for accident treatment?

Yes, if you have it — it keeps treatment moving and the negotiated insurance rates lower the amounts in play. Your plan will later assert a reimbursement claim against your settlement, and that reimbursement gets negotiated at the end like any lien.

What is Med-Pay and do I have it?

Medical payments coverage is an optional add-on to auto policies — commonly $1,000 to $10,000 — that pays medical bills for you and your passengers regardless of fault. Many people carry it without knowing. Check your declarations page, and your resident relatives’ policies too; using Med-Pay generally cannot raise your rates for a not-at-fault accident (10 CCR § 2632.13).
